Terms of Service
1. General
This website is operated by Dante’s Workshop. Throughout this website, the terms “Dante’s Workshop”, “we”, “us” and “our” refer to Dante’s Workshop.
These Terms of Service govern the use of our website and the purchase of products or services from Dante’s Workshop.
By accessing our website, placing an order, accepting a quotation or purchasing a product or service from us, you agree to these Terms of Service together with all policies referenced herein, including our Shipping Policy, Returns, Exchanges and Refund Policy and Privacy Policy.
Nothing in these Terms limits any mandatory rights that cannot legally be excluded or restricted.
2. Products and Services
Dante’s Workshop designs, develops and manufactures physical products ranging from standard products to Made to Order items, personalized products, individually commissioned products and complete custom development projects.
Certain products are maintained in finished inventory, while others are manufactured only after a confirmed order has been received.
Product availability, manufacturing method, estimated production time and other relevant information are displayed on the applicable product page or communicated separately as part of a quotation.
Because many of our products involve manual manufacturing, finishing, painting, assembly or other production processes, minor variations may occur between individual products.
Such normal manufacturing variations do not constitute a defect where they do not materially affect the agreed appearance, functionality or specifications of the product.
3. Product Images, Colors and Specifications
We make reasonable efforts to ensure that product photographs, descriptions, dimensions, specifications and other information accurately represent our products.
However, colors and surface appearance may vary slightly depending on lighting, photography, display settings, materials and the characteristics of manually finished surfaces.
Dimensions and weights identified as approximate may be subject to reasonable manufacturing tolerances.
Where exact dimensions, compatibility or another specification is essential for a particular application, customers are encouraged to contact Dante’s Workshop before placing the order.
In the event of an obvious typographical, technical or pricing error, Dante’s Workshop reserves the right to correct the information. Where such an error materially affects an already placed order, the customer will be contacted before the affected order is fulfilled.
4. Orders and Order Acceptance
Submitting an order through the website constitutes an offer to purchase the selected products under these Terms.
An order is considered accepted once Dante’s Workshop has confirmed the order and payment has been successfully received or otherwise arranged.
We reserve the right to refuse an order before acceptance where reasonably necessary, including in cases of suspected fraud, payment problems, legal restrictions, incorrect pricing, product unavailability or circumstances that prevent us from lawfully or reasonably fulfilling the order.
Where Dante’s Workshop is unable to fulfil an accepted and paid order and no alternative solution is agreed with the customer, any amount owed to the customer will be handled in accordance with applicable law.
5. In Stock Products
Products identified as In Stock are normally available from existing inventory.
Preparation and dispatch times are governed by our Shipping Policy and may vary depending on order size, packaging requirements and current workload.
Availability shown on the website may change until an order has been successfully completed.
6. Made to Order Products
Products identified as Made to Order are individually manufactured for a specific confirmed customer order and are not supplied from finished retail inventory.
Once a Made to Order product enters production, manufacturing capacity, materials, machine time, labor and finishing capacity are allocated specifically to that order.
The production time displayed on a product page is an estimate based on the expected manufacturing workload at the time and does not constitute a guaranteed completion or dispatch date.
Production times may change due to current workload, material availability, production complexity, technical requirements, supplier delays or other circumstances reasonably affecting manufacturing.
Made to Order products are subject to the specific return and refund conditions set out in our Returns, Exchanges and Refund Policy.
7. Custom, Personalized and Commissioned Work
Custom products, personalized products, development projects and individually commissioned work may be subject to additional specifications, quotations, payment schedules, milestones, approval processes and project specific terms.
Where separate written terms, quotations, specifications or contracts have been agreed for an individual project, those project specific terms take precedence over these general Terms to the extent that they address the same subject matter.
The customer is responsible for reviewing and approving specifications, measurements, design requirements, reference materials and other project information submitted for custom production.
Changes requested after design, engineering or manufacturing work has begun may result in additional cost and changes to the expected completion schedule.
No modification to the agreed scope is binding until accepted by Dante’s Workshop.
8. Production and Estimated Completion Times
Dante’s Workshop makes every reasonable effort to complete orders within the estimated production period communicated at the time of purchase.
Production times are estimates unless a specific completion date has been expressly guaranteed in writing.
Manufacturing schedules may be affected by production capacity, technical complexity, supply availability, necessary redesign or testing, equipment maintenance, third party suppliers and other circumstances reasonably outside the originally estimated production schedule.
Our priority is to deliver products that meet the intended quality and specifications rather than compromise manufacturing quality solely to meet an estimated production date.
Material changes affecting an order will be communicated to the customer where reasonably necessary.
9. Prices and Payment
All prices are displayed in the currency indicated on the website or quotation.
Applicable taxes, shipping charges and other costs are displayed or communicated separately where required.
Prices may change at any time before an order is placed. Changes in general product pricing do not affect an order that has already been accepted and paid for, except where the original price resulted from an obvious technical or pricing error.
Custom and business projects may be subject to individually agreed payment schedules, deposits, milestones or final payment requirements.
Where a quotation or separate agreement contains specific payment conditions, those conditions form part of the agreement between Dante’s Workshop and the customer.
10. Shipping and Delivery
Preparation, shipping, tracking, customs responsibilities and estimated transit times are governed by our Shipping Policy.
Delivery dates and carrier transit times are estimates unless expressly guaranteed in writing.
Once an order has been handed over to the carrier, tracking information provided by the carrier will be forwarded to the customer whenever available.
International customers are responsible for complying with applicable local import laws and for applicable customs duties, taxes and other charges as described in our Shipping Policy.
11. Returns, Repairs, Exchanges and Refunds
Returns, repairs, exchanges, statutory withdrawal rights and refunds are governed by our Returns, Exchanges and Refund Policy.
Dante’s Workshop aims to resolve legitimate product related issues as quickly and effectively as possible.
Where appropriate and legally permitted, our preferred remedy for a product related issue is repair first, followed by replacement where repair is not appropriate or possible.
Made to Order, custom made and personalized products are subject to the specific conditions described in the Returns, Exchanges and Refund Policy.
12. Product Use and Customer Responsibility
Customers are responsible for using, installing, maintaining and operating products appropriately and in accordance with any instructions, technical limitations or intended use communicated by Dante’s Workshop.
Unless expressly stated otherwise, products must not be assumed to possess certifications, safety ratings, protective capabilities, ballistic ratings, structural ratings or other regulated characteristics that have not been specifically stated by Dante’s Workshop.
A product’s appearance, material or construction must not be interpreted as evidence of a certification or performance rating that has not been expressly provided.
Customers are responsible for determining whether possession, import, installation or use of a product is permitted for their intended purpose and jurisdiction.
Dante’s Workshop is not responsible for damage resulting from misuse, unauthorized modification, improper installation, operation outside the communicated intended use, failure to follow provided instructions or ordinary wear and tear.
This does not exclude liability that cannot legally be excluded.
13. Modifications and Third Party Components
Unauthorized modification, disassembly, drilling, cutting, electrical modification, structural alteration or integration with incompatible third party products may affect the safety, functionality and eligibility of the product for voluntary repair or exchange services.
Where a product is designed to interface with a third party product, platform, replica, vehicle, equipment item or other system, compatibility is limited to the configurations expressly identified by Dante’s Workshop.
We cannot guarantee compatibility with later revisions, unofficial copies, modified products or variations produced by third parties unless specifically confirmed.
14. Intellectual Property
Unless expressly agreed otherwise in writing, all intellectual property rights relating to original Dante’s Workshop products and services remain the property of Dante’s Workshop.
This includes, where applicable, original designs, CAD models, engineering solutions, prototypes, drawings, photographs, graphics, documentation, branding, website content and other proprietary materials created by Dante’s Workshop.
Purchasing a physical product does not transfer intellectual property rights or grant permission to reproduce, manufacture, reverse engineer for commercial reproduction, distribute or commercially exploit the underlying Dante’s Workshop design.
Certain products offered by Dante’s Workshop may be inspired by, reference, recreate or otherwise relate to fictional characters, franchises, games, films, visual designs, trademarks or other intellectual property owned by third parties.
Unless expressly stated otherwise, Dante’s Workshop does not claim ownership of any third party trademarks, characters, fictional universes, logos, names, artwork or other protected intellectual property associated with such products. All respective intellectual property rights remain with their respective owners.
Such products are independently manufactured physical pieces and are not intended to imply official licensing, sponsorship, endorsement, partnership or affiliation with the respective rights holder unless this is explicitly stated by Dante’s Workshop.
Any intellectual property owned independently by Dante’s Workshop in relation to the engineering, manufacturing process, original modifications, technical solutions, production files or independently created elements of such a product remains the property of Dante’s Workshop to the extent permitted by applicable law.
Nothing in these Terms grants Dante’s Workshop ownership of third party intellectual property or grants the customer any rights in third party intellectual property beyond those that may lawfully arise from ownership of the physical product.
Custom development projects may contain separately agreed intellectual property ownership, licensing or confidentiality terms.
Where such terms exist, the separately agreed project terms take precedence.
15. Customer Supplied Materials and Intellectual Property
Where a customer provides logos, designs, artwork, CAD files, trademarks, reference materials or other content for use in a custom project, the customer represents that they have the necessary rights or permissions to provide and use those materials for the requested purpose.
The customer remains responsible for third party intellectual property contained in materials supplied by them.
Dante’s Workshop reserves the right to refuse work that we reasonably believe would unlawfully infringe third party rights.
16. Website Use
The website and its content may not be used for unlawful purposes.
Users may not attempt to interfere with website security, introduce malicious software, scrape restricted information, impersonate another person, submit intentionally false information or otherwise misuse the website or its services.
We may restrict access to the website or refuse service where reasonably necessary to protect Dante’s Workshop, our customers, our systems or third parties from abuse, fraud or unlawful activity.
17. Third Party Services
Our website and purchasing process may rely on third party service providers, including payment processors, ecommerce platforms, shipping carriers and other technical providers.
Where third party services are used, their operation may also be subject to their own terms and policies.
Dante’s Workshop is not responsible for interruptions or failures caused solely by independent third party services where those circumstances are outside our reasonable control, without limiting any responsibility that applicable law places on Dante’s Workshop toward the customer.
18. Limitation of Liability
To the maximum extent permitted by applicable law, Dante’s Workshop is not responsible for indirect or consequential losses that were not reasonably foreseeable at the time the relevant agreement was concluded.
Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by applicable law.
Any limitations contained in these Terms are subject to mandatory consumer protection, product liability and other applicable laws.
For business customers, additional or different limitations of liability may be agreed as part of a separate business contract.
19. Business Customers and Professional Projects
Business customers may purchase standard products under these Terms or enter into separately negotiated agreements with Dante’s Workshop.
Higher value professional projects may include individually agreed development obligations, specifications, acceptance procedures, warranties, service commitments, installation, commissioning, maintenance, training, operational support and full lifecycle support.
Where a separate business agreement exists, that agreement governs the relevant professional project and takes precedence over these Terms where the provisions differ.
Dante’s Workshop may therefore act not only as a product supplier but also as a development, manufacturing and long term technical support partner.
20. Force Majeure and Circumstances Outside Our Reasonable Control
Dante’s Workshop will not be responsible for delays or failure to perform caused by circumstances outside our reasonable control to the extent permitted by applicable law.
Such circumstances may include major transportation disruptions, carrier interruptions, natural disasters, government restrictions, war, civil disturbance, widespread infrastructure failures, serious supply chain disruption or other comparable events.
Where such circumstances materially affect an active order, Dante’s Workshop will make reasonable efforts to communicate the situation and continue performance as soon as reasonably possible.
21. Severability
If any provision of these Terms is determined to be invalid, unlawful or unenforceable, that provision will apply only to the maximum extent legally permitted.
The invalidity or unenforceability of one provision does not automatically affect the validity of the remaining provisions.
22. Entire Agreement
These Terms, together with the applicable policies, accepted quotation and any separately agreed written project terms, constitute the agreement governing the relevant purchase or service.
Where a separately negotiated written agreement expressly conflicts with these Terms, the separately negotiated provision takes precedence for that specific transaction.
23. Governing Law
These Terms and any agreements through which Dante’s Workshop provides products or services are governed by the laws of Hungary, without limiting any mandatory consumer protections that apply under applicable law.
24. Changes to These Terms
Dante’s Workshop may update these Terms from time to time to reflect changes to our services, business practices or applicable requirements.
The version applicable to a purchase is generally the version in effect when the relevant order or agreement was concluded, unless a later change is required by law or separately agreed with the customer.
